GENERAL CONDITIONS OF SALE
Purpose
The portal is owned by RELBER, SA with address at C / Barcelones nº7 08140 Caldes de Montbui, provided with CIF number A58471657, and registered in the Mercantile Registry of Barcelona.
RELBER can modify these General Purchase Conditions at any time. The modifications made will not affect, in any case, the purchases that have been made prior to the approval of said modifications, which will be governed in any case by the General Conditions in force at the time of making those other purchases. It is the responsibility of the user to know the General Purchase Conditions in force at the time of the beginning of the Purchase process.
These General Conditions can be completed or modified by specific clauses or specific conditions of certain products, especially with regard to the exclusion of the rights of withdrawal, exchanges or refunds. Please review the product information carefully for these specific conditions.
The electronic document in which the contract is formalized will be filed by RELBER, and can be consulted through our website with the authentication of your username and password or the means established in each case. A paper copy can be requested from Customer Service, relber@relber.com whose details are detailed in Clause 12 of these General Purchase Conditions.
By accepting the conditions, the user declares to be of legal age and have sufficient legal capacity to be bound by these General Purchase Conditions.
Applicable regulations
This electronic contract is concluded under Spanish regulations and specifically under the legal regime imposed by Law 34/2002 on Services of the Information Society and Electronic Commerce (LSSICE). The electronic contract will not be filed by a third party and the language for its conclusion is Spanish. These General Conditions of sale may be saved and reproduced at any time by the user who makes a purchase through the options of his Internet browser and must be read and accepted before finalizing the purchase.
User registration
In order to access the electronic purchase of Kave products, it is not necessary to register as a user of the page (www.relber.com), and you can make the purchase without the need for registration.
User registration is free and must be done through the "Register" tab provided on the website itself. At the end of the registration process, you will receive an email confirming that the process has been carried out correctly.
The user may access the section of registered users with their username and password or the means that, in each case, RELBER enables to authenticate users. In their profile, the user will be able to find relevant information such as that relating to previous orders or the shipping address provided.

Offer validity period
Without prejudice to the provisions of the specific legislation, electronic contracting offers or proposals will be valid for the period established by RELBER or, failing that, for as long as they remain accessible to the recipients.
Purchasing process
The Purchase Process is made up of the following steps:
(i) product selection: Browse our page and press the "Add to Cart" button each time you want to add a product to the purchase. The shopping cart contains the name of the selected product, the quantity and the price in euros.
(ii) start of the purchase process: To start the purchase process, press the "Process Order" button.

In any case, RELBER will issue a purchase confirmation by email, within a maximum period of 24 hours from receipt of the purchase order.

Once the purchase is confirmed, the customer may not modify or cancel the order outside of the cases provided by law or in these General Conditions.
Price, taxes and shipping costs
All prices indicated on the website are referred to in euros and include those taxes and fees applicable to the Spanish territory, without prejudice to the fact that the purchase of the products from another territory could accrue the corresponding taxes and / or corresponding duties. RELBER, through the bank details entered by the user on the website, will make a withholding for the final amount of the order.
Shipping costs will appear detailed at the end of the purchase process, and you must choose the desired shipping method. These shipping costs will be paid by the user in its entirety.

Delivery
Home delivery will be made from Monday to Friday. The user may specify any detail related to the shipment, as well as the delivery method according to the options provided by RELBER at all times.
Those shipments made outside the territory of the Iberian Peninsula, may entail additional charges regarding the transport and delivery of the products that, in any case, will be informed to the user during the purchase process.
The user will acquire ownership of the object products once they have satisfied the entire agreed price.
In the event that delivery is not possible, Kave is empowered to cancel the contract due to impossibility of performance and without prejudice to the claims that RELBER may initiate in the event of fraud or fault of the user.
RELBER will not be responsible for the state in which the products are delivered to the user in case of impossibility of the delivery of the order within the agreed period for reasons attributable to the user.
The assumption of risk by the user with respect to the products will take place at the time of delivery of the same and this regardless of when the user acquires ownership of the products. Therefore, RELBER will not be responsible for any theft, robbery, deterioration, damage or loss of the products that occurs after the delivery of possession of these to the user.
Responsibility for delivery
RELBER does not guarantee the permanent availability of the products, being exonerated from any type of responsibility provided that it does not cause a malicious breach on the part of RELBER, or that it derives from errors in the unavailability of the service of the telematic data transfer networks outside their will.
Likewise, RELBER will be released from compliance with its delivery obligations set forth in Clause 9 above, and declines all responsibility in this regard, in the following cases:
Total or partial non-payment of the user.
Omission or inaccuracy of the information that, in accordance with Clauses 3, 5, 6 and 7, the user must provide in the purchase order at the time of placing the order.
Withdrawal
11.1.- WITHDRAWAL
In accordance with the provisions of Spanish legislation, the user has the right of withdrawal, by virtue of which he may return the product received if he finds that it does not meet his expectations.
The exercise of this right of withdrawal is reserved to those users who act as consumers and / or users, in accordance with the definition given of them by Royal Legislative Decree 1/2007 of November 16, which approves the text recast of the General Law for the Defense of Consumers and Users, which can be exercised within a maximum period of fourteen (14) calendar days from receipt and according to the official calendar of the place where the good has been delivered. In order to exercise this right, the product must be in perfect condition and keep the original packaging.
The refund of the purchase amount will be made and with the same means of payment used for the payment of the order and, in any case, within a maximum of fourteen (14) calendar days from the reliable receipt of the withdrawal request, provided that when RELBER is the one who manages the collection of the product. In the event that the user returns the product through a transport company of their choice, as long as RELBER has effective knowledge of the shipment of the product or, failing that, from the receipt of the same.
The return costs derived from the exercise of the right of withdrawal will be paid by RELBER only when they correspond to shipments originally destined for the territories of Spain, France and Italy; however, initial shipping costs will not be reimbursed at any time. The customer must return the products or deliver the goods to the address specified by RELBER at all times or, failing that, to the following address: Polígono Industrial La Borda, C / Barcelones nº7, 08140 Caldes de Montbui (Barcelona).
In the event that the products do not arrive in perfect condition, RELBER reserves the right to pay a lower amount for your order, being able to endorse those amounts that the user must pay for the breach of the obligations established herein.
To exercise the right of withdrawal, the user must notify RELBER, at C / Barcelones nº7 08140 Caldes de Montbui, with telephone (+34) 93 865 40 05 and email relber@relber.com , your decision to withdraw from the purchase made, through an unequivocal statement, by post, or email.
11.2.- DEFECTIVE OR DAMAGED PRODUCT DURING TRANSPORT.
When the product has been damaged during transport, it is essential that the user notify it by telephone the same day of receipt of the products and write it down on the delivery note of the carrier.
RELBER will bear the shipping costs for the delivery and return of the product.
If the user wishes to return the merchandise with a transport company other than the one proposed by RELBER and the transport company selected by the user offers higher rates, the user will assume the difference in the cost of transport.
Before opening any product, the user must verify that the packaging matches the one requested (model, color, size, finish, etc.), making an immediate claim, in case there is any anomaly. If the user detects any anomaly before opening the product, RELBER asks that the seal or its packaging do not be opened.

Warranty
All our products are guaranteed at the national level, against manufacturing defects for 1 year, except for those products that indicate another term.
The warranty is expressly excluded in the following cases:
a) Transportation, accidents, improper use and other damages not due to the normal use of the product by the customer after the delivery of the merchandise. This warranty only covers transport damage caused before the material is received.
b) Transport the product without the original packaging.
c) Signs, scratches or other damage caused by animals or by improper use of the product.
d) Use or contact with chemical products (acids, solvents, dyes, paint, ammonia, lacquers or other products ...).

h) Mixing the products with others, altering the original product.
Overwhelming force
RELBER will not be liable for the total or partial breach of the obligations derived from this contract or for the delay in the realization of the same if said breach is due to a circumstance of force majeure, including general, territorial or sectorial strikes, flood, fire, etc.

In compliance with the provisions of EU Regulation 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of These data, and in the current regulations applicable at all times, we inform you that your personal data collected through this document will be processed and incorporated into a file owned by Relber, SA in order to comply with the existing commercial relationship between you and our company.
Personal data may be communicated to third parties without the consent of the owner provided that such communication responds to a need for development, compliance and control of the commercial relationship, and / or is limited to the aforementioned purposes, in accordance with the current applicable regulations on the matter.
Consequently, you expressly consent to your data being processed by Relber, SA for the fulfillment of the aforementioned purposes.

Intellectual property
RELBER reserves all intellectual property rights over the documentation provided to the user.
Nullity or voidability and applicable law and jurisdiction
If any of the clauses of this contract turn out to be null, voidable, illegal or illicit, in such case, and in the broadest interpretive sense allowed by law (a) said declaration will not invalidate the rest of the contract, which will maintain its validity and effectiveness. , and (b) the null or voidable clause or clauses shall preferably be replaced or adjusted to be annulled.
The previous conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established. RELBER and the user, agree to expressly renounce any other jurisdiction and submit any controversy that may arise from the provision of the products or services object of these, Conditions, to the Courts and Tribunals of the city of Barcelona.
